Fitness for Practice Director

Medical Council Ireland is looking to recruit a Fitness to Practice Director (Senior Officer). Reporting to the Medical Council’s Chief Executive Officer, the Fitness for Practice Director is responsible for overseeing and managing the Medical Council’s Fitness for Practice (FTP) function and is a member of the leadership team .

The primary purpose of the fitness to practice function is to support the Medical Council’s goal of protecting the public by promoting and ensuring high standards of professional conduct and professional education, training and competence among doctors.

Cases are referred to the Fitness to Practice Committee (“CFPT”) after initial investigation by the Preliminary Prosecutions Committee so that an investigation can be conducted into a complaint against a physician. The FTPC is responsible for hearing the evidence and deciding whether or not to find against a doctor. If the FTPC makes findings, it also makes recommendations regarding the sanction. The Medical Council decides on the sanction and usually this must then be upheld by the High Court.

Key responsibilities will include:

  • Case management and legal instruction on all referrals to the FTPC by the Preliminary Proceedings Committee; including all actions before and after the investigation and appeals
  • Management of investigative hearings by the FTPC
  • Management of sanction hearings at the Council
  • Management of legal proceedings arising from the FTPC process
  • Enforcement and monitoring of all covenants, conditions, notifications and publications relating to an individual registrant arising from any aspect of the Board’s regulatory responsibilities, including any request for suspension
  • Management of external legal providers regarding services provided to FTP to include cost management and budgeting
  • Play a leading role in the significant change program currently underway within the Council.
  • Implement an effective organizational structure to support the function’s mandate and effective integration with other parts of the Board.

Essential criteria:

  • Professional legal qualification as an attorney or state-licensed attorney with at least 8 years of relevant post-qualification experience as a practitioner of law
  • Recent experience at a senior level in a similar role
  • Strong leadership and management experience
